Welcome to SMYTECH. These Terms govern your access to and use of our websites, products, and services.

By accessing or using any SMYTECH site or service, you agree to these Terms and our Privacy Policy. If you are using our services on behalf of an organization, you represent you have authority to bind that organization.
2. Eligibility & Accounts
- You must be at least 16 (or the age of digital consent in your region) to use our services.
- You are responsible for safeguarding your account credentials and for all activities under your account.
- Provide accurate information and keep it up to date. We may suspend accounts for suspected fraud, abuse, or non-compliance.
3. Services & Orders
We provide software development, consulting, hosting, support, and digital goods (e.g., themes). Project scopes are defined in statements of work (SOWs) or order forms. Delivery timelines are estimates.
4. Fees, Taxes & Billing
- Prices are quoted exclusive of applicable taxes unless stated otherwise.
- Subscriptions renew automatically unless cancelled according to the plan terms.
- Late or failed payments may result in suspension. You authorize us to charge your payment method for recurring fees.
5. User Content & License
You retain ownership of your content. You grant SMYTECH a worldwide, non-exclusive license to host, process, and display your content solely to provide the services and as otherwise permitted by you.
6. Acceptable Use
- No unlawful, infringing, harmful, or abusive activity.
- No reverse engineering, bypassing security, or misuse of APIs.
- No transmission of malware or disallowed data (e.g., illegal content, others’ personal data without consent).
7. Intellectual Property
SMYTECH and its licensors retain all rights to the services, software, templates, and marks. Except as expressly permitted, you may not copy, modify, or create derivative works of our IP.
8. Confidentiality
Each party may disclose confidential information to the other. The receiving party will protect it using reasonable measures and use it only for the project or service delivery.
9. Third-Party Services
Third-party products or integrations are governed by their own terms. We are not responsible for third-party acts or omissions.
10. Beta Features
Betas or previews are provided “as is,” may be discontinued, and may not be production-ready.
11. Disclaimers
To the fullest extent permitted by law, the services are provided “as is” and “as available,” without warranties of any kind, express or implied (including merchantability, fitness for a particular purpose, and non-infringement).
12. Limitation of Liability
To the maximum extent permitted by law, SMYTECH will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, even if advised of the possibility. Our aggregate liability under these Terms will not exceed the amounts paid by you to SMYTECH in the 12 months before the event giving rise to the claim.
13. Indemnification
You will defend and indemnify SMYTECH against third-party claims arising from your content, your use of the services in violation of these Terms, or your breach of applicable law.
14. Suspension & Termination
We may suspend or terminate access for breach, risk to the platform, non-payment, or legal compliance. You may stop using the services at any time. Sections intended to survive (e.g., IP, confidentiality, liability limits) will survive termination.
15. Governing Law & Disputes
These Terms are governed by the laws of [Insert governing jurisdiction], excluding conflict-of-laws rules. Disputes will be resolved in the courts of [Insert venue]. You and SMYTECH waive class actions to the extent permitted by law.
